Each company accepting responsibility selects its line items and signs. Its liability is capped at 125% of the estimate for those lines, or of a revised sum the Port provides in writing.

Under Tariff Item No. 199.000, where the party responsible for payment has not established credit worthiness with the Port, and responsibility has not been accepted by another credit-worthy entity, the Port requires cash in advance or acceptable security before the vessel berths.

Conditions of vessel berth reservation

In accordance with Federal Maritime Commission Docket 83-48, Alaska Maritime Agencies, Inc., et al. v. Port of Anacortes, et al., and Tariff Item 199.000 in the Port of Olympia Terminal Tariff No. 11, all applications for vessel berth reservation shall be made in the form specified by the Port and require timely filing of the financial responsibility information in the Supplement, completed in accordance with and governed by the terms below.

  1. Except where and to the extent waived under paragraph B, terms of payment for all applicable Port charges shall be cash in advance. A cash deposit or acceptable security equal to 125% of the estimated applicable charges must be posted with the Port six (6) days before the vessel’s scheduled arrival, or at another time authorized or directed by the Port, but in all cases before services are rendered. Any excess of a cash deposit, after all applicable port charges are satisfied, will be promptly refunded to the party that posted it.
  2. The Port may waive cash in advance for all or any category of anticipated port charges when the party responsible has been identified by the berthing agent to the Port’s satisfaction, and:
    1. that party has established credit worthiness acceptable to the Port; or
    2. adequate security acceptable to the Port, equal to 125% of the applicable estimated charges, has been posted; or
    3. the agent requesting the berth, or another entity acceptable to the Port as credit worthy, has personally accepted financial responsibility for the applicable charges.
  3. The vessel agent or other person requesting the berth (“berthing agent”) shall provide, to the extent of their knowledge, all information called for in the Supplement: the vessel, its estimated arrival and departure, the amounts and types of cargo to be loaded or discharged, an estimate of each category of port charges, and the party responsible for each. Submitting this form, signed by the berthing agent, is the berthing agent’s attestation to the accuracy of the information, based on what was available at submission. The berthing agent is personally liable to the Port for any financial loss resulting from failure to report accurately.
  4. If, after submitting this form, the berthing agent receives information that materially differs from what was provided, and reasonably believes the Port does not equally know it, the agent shall notify the Port immediately and, if requested, promptly file an amended Supplement.
  5. All estimates of port charges are subject to approval and/or adjustment by the Port.
  6. Promptly after receiving this form, the Port will advise the berthing agent of (1) its approval or adjusted estimate of port charges, and (2) whether cash or security must be posted for any category of charges, and the amount.
  7. In addition to these terms, berth reservation requests and berth assignments are subject to all local rules and regulations established by the Port.
